End User Licence Agreement

Introduction
This licence agreement is a contract (the “Licence”) between you, the person using this software product (the “Game”), and Rebellion Interactive Limited (“Rebellion”). Your installation or use of the Game indicates your acceptance of the terms of this Licence.
This Licence is in addition to (rather than instead of) the terms which apply between you and distribution platforms like those operated by Sony, Microsoft and Valve (“Platform Terms”), and this Licence does not change the Platform Terms. Game sales and refunds may be covered in the Platform Terms operated by the company you paid for a licence to use the Game.
Licence
Rebellion hereby grants you a limited, non-exclusive, non-transferable licence to install the Game on your home computer or console device and to use the Game in accordance with the user instructions published by Rebellion and solely for your personal entertainment. All other rights are reserved to Rebellion.
Ownership
The Game is licensed, not sold, and no rights, title or ownership in the Game (or any part of it) are transferred to you. All intellectual property rights in or relating to the Game are the sole property of Rebellion.
Limitations on Use
You agree that you shall not: (a) exploit any part of the Game commercially or in return for any valuable consideration; (b) sell, lease, rent, license, distribute or otherwise transfer the Game without the approval of Rebellion; (c) reverse engineer, modify, decompile, create derivative works of or disassemble the Game (except to the extent that Rebellion is required by law to permit, and then only after notifying Rebellion of your intention to do so); or (d) circumvent or disable or remove any copy protection technology or copyright or trade mark notices.
Data Use
Our privacy policy at rebellion.com/games/privacy-policy/ sets out the data we collect and other important information relating to your data.
Code of Conduct
Use of the Game is conditional on you abiding by our player code of conduct at rebellion.com/games/player-code-of-conduct/ which is incorporated into and forms a part of this Licence.
Disclaimer
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, REBELLION DISCLAIMS ALL OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT IN RESPECT OF THE GAME.
Limitation of Liability
IN NO EVENT SHALL REBELLION BE LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE OR ANY ECONOMIC LOSS UNDER OR IN CONNECTION WITH THIS LICENCE OR IN ANY OTHER MANNER IN CONNECTION WITH THE GAME.
THE ENTIRE LIABILITY OF REBELLION UNDER OR IN CONNECTION WITH THIS LICENCE OR IN ANY OTHER MANNER IN CONNECTION WITH THE GAME SHALL BE LIMITED TO AN OBLIGATION EITHER TO REFUND THE PURCHASE PRICE FOR THE GAME OR TO PROVIDE A REPLACEMENT COPY OF THE GAME (AS DETERMINED BY REBELLION IN ITS SOLE DISCRETION).
However, nothing in this Licence shall limit the liability of Rebellion for fraudulent misrepresentation, personal injury caused by Rebellion’s negligence, or any other form of liability which cannot be limited or excluded by contract.
The following terms apply to PlayStation® Games:
- This EULA is between you and Rebellion, not between you and any part of the Sony group.
- Rebellion is solely responsible for the Game.
- You are granted a limited licence to use the Game on a PlayStation® Platform that you own or control or such other system to which the Game is delivered by PlayStation™Network.
- Each SIE Group Company (or the SIE Group Company for the region where the Game is being sold if this EULA is regional) is a third party beneficiary of this EULA.
Sony Interactive Entertainment Network Europe Limited (“SIENE”)
Any content purchased in an in-game store will be purchased from Sony Interactive Entertainment Network Europe Limited (“SIENE”) and be subject to PlayStation™Network Terms of Service and User Agreement which is available on the PlayStation™Store. Please check usage rights for each purchase as these may differ from item to item. Unless otherwise shown, content available in any in-game store has the same age rating as the game.

Purchase and use of items are subject to the Network Terms of Service and User Agreement. This online service has been sublicensed to you by Sony Interactive Entertainment America.
DRM
The following notice applies if the Game uses Denuvo DRM software.
THE PRODUCT IS PROTECTED BY DIGITAL RIGHTS MANAGEMENT SOFTWARE (“DRM SOFTWARE”) AND DENUVO ANTI-TAMPER PROTECTION TECHNOLOGY (“ANTI-TAMPER TECHNOLOGY”). YOU HEREBY AGREE, ACKNOWLEDGE AND CONSENT TO THE FOLLOWING REGARDING THE DRM SOFTWARE: (I) THE INSTALLATION OF THE PRODUCT WILL CAUSE THE DRM SOFTWARE TO BE INSTALLED ON YOUR COMPUTER; (II) THE DRM SOFTWARE MAY LIMIT THE NUMBER OF INSTALLATIONS OF THE PRODUCT; (III) THE DRM SOFTWARE MAY INSTALL ON YOUR COMPUTER ADDITIONAL COMPONENTS REQUIRED FOR COPY PROTECTION; (IV) DURING THE INSTALLATION AND/OR THE FIRST LAUNCH OF THE PRODUCT, AN ONLINE CONNECTION MAY BE REQUIRED TO UNLOCK THE PRODUCT THROUGH THE DRM SOFTWARE AND (V) CERTAIN FILES OF THE ANTI-TAMPER TECHNOLOGY MAY REMAIN EVEN AFTER THE PRODUCT IS UNINSTALLED FROM YOUR COMPUTER.
IN NO EVENT SHALL REBELLION BE LIABLE IN CONNECTION WITH THE COMPONENTS THAT MAY BE INSTALLED ON YOUR COMPUTER BY ANY DRM SOFTWARE OR IN CONNECTION WITH THE ANTI-TAMPER TECHNOLOGY.
Jurisdiction
This Licence shall be construed according to English law and the English courts have exclusive jurisdiction over any dispute concerning the Game or this Licence. Except to the extent specified above no terms of this Licence are enforceable by a third party pursuant to the Contracts (Rights of Third Parties) Act 1999. However, the parties to this EULA may rescind or vary this EULA without the consent of any third party.
